Purpose of the data processing
General purpose of the processing
We use your data solely for our service. That means the purpose of the processing is always directly connected to the order you place. We do not use your data for targeted marketing. If you share data with us and we use that data to contact you at a later moment, other than at your own request, we ask your explicit permission for that. Your data is not shared with third parties, other than to meet bookkeeping and other administrative obligations. All those third parties are bound to confidentiality on the basis of the agreement between them and us, an oath or a statutory obligation.
Automatically collected data
Data collected automatically by our website is processed with the aim of improving our service further. This data (for example your IP address, web browser and operating system) is not personal data.
Cooperation with tax and criminal investigations
In certain cases WCMK b.v. may be required by law to share your data in connection with a tax or criminal investigation by the authorities. In such a case we are forced to share your data, but we will resist that within the possibilities the law offers us.
Retention periods
We keep your data for as long as you are our customer. That means we keep your customer profile until you tell us you no longer wish to use our services. If you tell us that, we also treat it as a request to be forgotten. It also means we do not keep your data longer than two years from the last contact or transaction, unless there is a statutory ground for doing so. Under applicable administrative obligations we have to keep invoices containing your personal data, so we keep that data for as long as the applicable period runs. Employees, however, no longer have access to your customer profile and to documents we produced in connection with your order.
Your rights
Under applicable Dutch and European legislation you as a data subject have certain rights regarding the personal data processed by us or on our behalf. Below we explain what those rights are and how you can invoke them. To prevent misuse we send transcripts and copies of your data only to the email address already known to us. If you wish to receive the data at another email address or by post, for example, we will ask you to identify yourself. We keep a record of handled requests; in the case of a request to be forgotten we record anonymised data. You receive all transcripts and copies of data in the machine readable data format we use within our systems. You always have the right to file a complaint with the data protection authority if you suspect that we are using your personal data incorrectly.
Right of access
You always have the right to view the data we process or have processed that relates to you or can be traced back to you. You can send a request to that effect to our privacy contact person. You then receive a reply to your request within 30 days. If your request is granted, we send a copy of all data to the email address known to us, with an overview of the processors holding that data, stating the category under which we have stored it.
Right of rectification
You always have the right to have the data we process or have processed that relates to you or can be traced back to you corrected. You can send a request to that effect to our privacy contact person. You then receive a reply within 30 days. If your request is granted, we send a confirmation to the email address known to us that the data has been changed.
Right to restriction of processing
You always have the right to restrict the processing of data we process or have processed that relates to you or can be traced back to you. You can send a request to that effect to our privacy contact person. You then receive a reply within 30 days. If your request is granted, we send a confirmation to the email address known to us that the data will no longer be processed until you lift the restriction.
Right to data portability
You always have the right to have the data we process or have processed that relates to you or can be traced back to you processed by another party. You can send a request to that effect to our privacy contact person. You then receive a reply within 30 days. If your request is granted, we send transcripts or copies of all data about you that we have processed, or that has been processed on our behalf by other processors or third parties, to the email address known to us. In all likelihood we can no longer continue the service in such a case, because the secure linking of data files can then no longer be guaranteed.
Right to object and other rights
In certain cases you have the right to object to the processing of your personal data by or on behalf of WCMK b.v. If you object, we immediately stop the data processing pending the handling of your objection. If your objection is well founded, we make transcripts and copies of the data we process or have processed available to you and then stop the processing permanently. You also have the right not to be subject to automated individual decision making or profiling. We do not process your data in a way that makes this right applicable. If you think otherwise, please contact our privacy contact person.
