Privacy policy WCMK B.V.

About our privacy policy

WCMK b.v. cares a great deal about your privacy. We therefore process only the data we need in order to provide and improve our services, and we handle the information we have collected about you and your use of our services with care. We never make your data available to third parties for commercial purposes.

This privacy policy applies to the use of the website and the services offered through it by WCMK b.v. These terms took effect on 08/09/2023; when a new version is published, all previous versions cease to apply. This privacy policy describes which data about you we collect, what that data is used for, and with whom and under what conditions it may be shared with third parties. We also explain how we store your data, how we protect it against misuse, and what rights you have in relation to the personal data you have provided to us.

If you have any questions about our privacy policy, you can contact our contact person for privacy matters; you will find the contact details at the end of this privacy policy.

About the processing of your data

Below you can read how we process your data, where we store it or have it stored, which security measures we apply, and who has access to the data.

Online shop software

Shopify

Our online shop was built using software from Shopify. Personal data that you provide to us for the purpose of our services is shared with this party. Shopify has access to your data in order to give us technical support; they will never use your data for any other purpose. Under the agreement we have entered into with them, Shopify is obliged to take appropriate security measures. These security measures consist of the use of SSL encryption and a strong password policy. Shopify uses cookies to collect technical information about your use of the software; no personal data is collected or stored in the process. Shopify reserves the right to share collected data within its own group of companies in order to improve its services further.

Web hosting

Shopify

We obtain web hosting and email services from Shopify. Shopify processes personal data on our behalf and does not use your data for its own purposes. This party may, however, collect metadata about the use of the services. This is not personal data. Shopify has taken appropriate technical and organisational measures to prevent the loss and unauthorised use of your personal data. Shopify is bound to confidentiality under the agreement.

Email and mailing lists

Klaviyo

Our website uses Klaviyo, a third party that handles the email traffic originating from our website and the sending of any newsletters. All confirmation emails you receive from our website and web forms are sent via the servers of Shopify. Klaviyo will never use your name and email address for its own purposes. At the bottom of every email sent automatically via our website you will find the 'unsubscribe' link. If you click on it, you will no longer receive email from our website. This may seriously reduce the functionality of our website. Your personal data is stored securely by Klaviyo. Klaviyo uses cookies and other internet technologies that show whether emails are opened and read. Klaviyo reserves the right to use your data to improve its services further and, in that context, to share information with third parties.

Shopify

For our regular business email traffic we use the services of Shopify. This party has taken appropriate technical and organisational measures to prevent the misuse, loss and corruption of your data and ours as far as possible. Shopify has no access to our mailbox and we treat all our email traffic as confidential.

Payment processors

To handle some of the payments in our online shop we use the platform of Mollie. Mollie processes your name, address and place of residence and your payment details such as your bank account or credit card number. Mollie has taken appropriate technical and organisational measures to protect your personal data. Mollie reserves the right to use your data to improve its services further and, in that context, to share anonymised data with third parties. All the safeguards mentioned above regarding the protection of your personal data apply equally to those parts of Mollie's services for which they engage third parties. Mollie does not keep your data longer than the statutory retention periods permit.

Kiyoh reserves the right to engage third parties in order to deliver its services, for which we have given Kiyoh our permission. All the safeguards mentioned above regarding the protection of your personal data apply equally to those parts of Kiyoh's services for which they engage third parties. Kiyoh keeps your personal data for as long as you keep the review published on the platform. Kiyoh has appointed a Data Protection Officer; you will find the contact details of this officer on the Kiyoh website.

WebwinkelKeur

We collect reviews through the platform of WebwinkelKeur. If you leave a review via WebwinkelKeur, you are required to provide a name and email address. WebwinkelKeur shares this data with us so that we can link the review to your order. WebwinkelKeur also publishes your name on its own website. For that purpose it is necessary for us to share your name, address and place of residence with Maximus Packing. Maximus Packing uses this data only to perform the agreement. If Maximus Packing engages subcontractors, Maximus Packing also makes your data available to those parties.

Purpose of the processing

General purpose of the processing

We use your data solely for the purpose of our services. This means that the purpose of the processing is always directly connected to the instruction you give us. We do not use your data for targeted marketing. If you share data with us and we use that data to contact you at a later moment other than at your request, we will ask for your explicit consent to do so. Your data is not shared with third parties, other than to meet accounting and other administrative obligations. All these third parties are bound to confidentiality on the basis of the agreement between them and us, or of an oath or a statutory obligation.

Automatically collected data

Data that is collected automatically by our website is processed with the aim of improving our services further. This data, for example your IP address, web browser and operating system, is not personal data.

Cooperation with tax and criminal investigations

In certain cases WCMK b.v. may be required by law to share your data in connection with a tax or criminal investigation by the authorities. In such a case we are obliged to share your data, but we will resist doing so within the limits the law allows us.

Retention periods

We keep your data for as long as you are a customer of ours. This means that we keep your customer profile until you tell us that you no longer wish to use our services. If you tell us this, we will also treat it as a request to be forgotten. It also means that we keep your data for no more than two years from the last point of contact or transaction, unless there is a statutory ground that justifies keeping it longer. Under the applicable administrative obligations we are required to keep invoices containing your personal data, so we will keep that data for as long as the applicable period runs. Staff, however, no longer have access to your customer profile or to documents we produced in connection with your instruction.

Your rights

Under applicable Dutch and European law you have, as a data subject, certain rights regarding the personal data processed by us or on our behalf. Below we explain what these rights are and how you can invoke them. In principle, and in order to prevent misuse, we send transcripts and copies of your data only to the email address already known to us. If you wish to receive the data at a different email address or, for example, by post, we will ask you to prove your identity. We keep a record of requests we have handled; in the case of a request to be forgotten we record anonymised data. You will receive all transcripts and copies of data in the machine readable data format we use within our systems. You have the right at any time to lodge a complaint with the Information Commissioner's Office if you suspect that we are using your personal data improperly.

Right of access

You always have the right to inspect the data that we process or have processed and that relates to you or can be traced back to you. You can submit a request to that effect to our contact person for privacy matters. You will then receive a response to your request within 30 days. If your request is granted, we will send a copy of all data to the email address known to us, together with an overview of the processors that hold this data, stating the category under which we have stored it.

Right to rectification

You always have the right to have the data that we process or have processed and that relates to you or can be traced back to you corrected. You can submit a request to that effect to our contact person for privacy matters. You will then receive a response to your request within 30 days. If your request is granted, we will send a confirmation to the email address known to us stating that the data has been amended.

Right to restriction of processing

You always have the right to restrict the processing of data that we process or have processed and that relates to you or can be traced back to you. You can submit a request to that effect to our contact person for privacy matters. You will then receive a response to your request within 30 days. If your request is granted, we will send a confirmation to the email address known to us stating that the data will no longer be processed until you lift the restriction.

Right to data portability

You always have the right to have the data that we process or have processed and that relates to you or can be traced back to you handled by another party. You can submit a request to that effect to our contact person for privacy matters. You will then receive a response to your request within 30 days. If your request is granted, we will send transcripts or copies of all data about you that we have processed, or that has been processed on our instruction by other processors or third parties, to the email address known to us. In all likelihood we will not be able to continue providing our services in such a case, because the secure linking of data files can then no longer be guaranteed.

Right to object and other rights

In certain cases you have the right to object to the processing of your personal data by WCMK b.v. or on its instruction. If you object, we will immediately stop processing the data pending the handling of your objection. If your objection is well founded, we will make transcripts or copies of the data that we process or have processed available to you and will then stop the processing permanently. You also have the right not to be subject to automated individual decision making or profiling. We do not process your data in a way that makes this right applicable. If you believe that we do, please contact our contact person for privacy matters.

Cookies from the American company Google are placed via our website as part of the 'Analytics' service. We use this service to track and receive reports on how visitors use the website. This processor may be obliged under applicable laws and regulations to give access to this data. We collect information about your browsing behaviour and share this data with Google. Google can interpret this information in combination with other data sets and in that way follow your movements on the internet. Google uses this information to offer targeted advertising, Adwords, among other things, as well as other Google services and products.

Third party cookies

Where software solutions from third parties use cookies, this is stated in this privacy policy.

Changes to the privacy policy

We reserve the right to amend our privacy policy at any time. You will, however, always find the most recent version on this page. If the new privacy policy affects the way in which we process data we have already collected about you, we will notify you of this by email.
